On January 29, 2006, a 22-year-old woman was in a New York City taxi cab when a drunk driver ran a red light at an intersection and struck her cab. The woman was ejected from the cab as a result of the collision and was rushed to New York Presbyterian Hospital. Her left arm has very little mobility and she requires care 24/7.
The drunk driver was found to be 60% at fault for the accident and the other 40% was attributed to the nightclub that served the driver. Samuel L. Davis won a $20.4 million judgement for the woman and the damages she suffered.

A 57-year-old man was a pedestrian at an unmarked crosswalk and was traveling from the eastbound side of JFK Boulevard East to the westbound side in Weehawken, New Jersey when he was struck by an inattentive driver. Our client, while driving a tractor-trailer was injured after a three-way collision on the Long Island Expressway in New York. Cervical Discectomy: Cervical discectomy is a major surgery to remove a herniated or degenerative disc in the neck. Typical recovery time in patients is two to six weeks, with most people being able to continue normal activity.
DDD (Degenerative Disc Disease): The term degenerative disc disease is not really a disease, but a term used to describe the normal changes of the discs in the spine as a person ages. It can also occur due to an injury. The breakdown of the discs can result in back pain, neck pain, or other problems. The pain can range from minor to excruciating.
Herniated Discs: Herniation describes an abnormality of the intervertebral disc that is also known as a “slipped,” “ruptured,” or “torn” disc. This process occurs when the inner core (nucleus pulposus) of the intervertebral disc bulges out through the outer layer of ligaments that surround the disc (annulus fibrosis). This tear in the annulus fibrosis may cause pain in the back at the point of herniation. If the protruding disc presses on a spinal nerve, the pain may spread to the area of the body that is served by that nerve. Between each vertebra in the spine are a pair of spinal nerves, which branch off from the spinal cord to a specific area in the body. Any part of the skin that can experience hot and cold, pain or touch refers that sensation to the brain through one of these nerves. In turn, pressure on a spinal nerve from a herniated disc may cause pain in the part of the body that is served by that nerve.
Laminectomies: a surgical operation to remove the back of one or more vertebrae, usually to give access to the spinal cord or to relieve pressure on nerves
Post-Concussion Syndrome: Persisting headaches, dizziness, problems with concentration and memory weeks after a head injury.
Spinal Fusions: surgery to permanently connect two or more vertebrae in the spine, eliminating motion between them.
Spondylosis: small crack or displacement between two vertebrae.
While driving on the Newark-Jersey City Turnpike in Kearny, New Jersey, a 47-year-old woman was rear-ended and forced to collide into the car driving in front of her. Davis, Saperstein & Salomon, P.C., Partner Samuel L. Davis proved that the driver who rear-ended her had been negligent in his failure to drive safely, securing our client a $2.25 million settlement.
The defendant was driving at 55 mph when he began coughing, causing him to accidentally step on his accelerator. He rear-ended the woman while traveling at 65 mph. Arthroscopy: A surgical procedure that allows the surgeon to complete a procedure by inserting a small camera through a small incision.
Cervical Discectomy: A cervical discectomy is a major surgery done that removes a damaged vertebral disc in the neck. Removing the disc relieves symptoms caused by nerve and spinal cord compression, such as pain in the neck. Most patients recover from the surgery within two to six weeks, and most can continue with their normal activities.
Debridement: A procedure to remove dead tissue from an injury or wound.
Disc Bulge: The discs in our spine have two components: a nucleus pulposus (new-klee-us pul-poe-sis) and the annulus fibrosis (an-you-lus-fye-bro-sis). The annulus fibrosis is the tough band that contains the nucleus pulposus, which is the disc’s soft inside. A bulging disc means that the nucleus pulposus is sagging and bulging out into the spinal canal, but it hasn’t torn the annulus fibrosis. A disc herniation means that the nucleus pulposus has made a hole or tear in the annulus fibrosis and it is leaking into the spinal canal.
Hyper-Extension Flexion Injury: This injury occurs when the neck is suddenly thrown forward, stretching and tearing tissues in the spine.
Impingement Syndrome: Occurs when tendons in the rotator cuff are continuously pinched.
Labral Tear: A labral tear can happen in the cartilage of either the hip or the shoulder joint that holds the ball and socket parts together. A tear can cause decreased range of motion, pain, and the feeling that the hip or shoulder is locking up.
Laryngoscopy: A surgical procedure in which a tube is inserted into the patient’s throat. Cymetra is a special, injectable collagen used for vocal cord augmentation procedures.
SLAP Lesion: A Superior Labrum from Anterior to Posterior (SLAP) lesion is a tear within the top of the labrum, otherwise known as the glenoid labrum.
Tendinosis: The degeneration of a tendon’s collagen.
A United Airlines baggage handler was severely injured after a van crashed into an airplane tug, causing him to get stuck between the tug and a metal pillar. The van had swerved into the tug to avoid a truck that had veered across the center lane of the road. The truck had moved across the center lane to avoid colliding with the tug. The van, truck, and baggage handler were all on a restricted vehicle service road (RVSR) in Terminal C of Newark International Airport in Newark, New Jersey. RVSRs are roadways meant only for airport vehicles, such as vehicles shuttling passengers. The van was driving west on the RVSR while the truck was traveling east. The truck first swerved across the center lane to avoid an airplane tug, which was blocking a part of the road. Because the truck swerved into the lane, the van swerved also, colliding into the tug. The client was standing between the tug and a metal pillar. When the van collided with the tug, our client’s right leg was forcefully pinned between the pillar and the tug itself.
MIC-5, the unit assigned to provide 24-hour coverage for all EMS needs and requests in the New York and New Jersey Port Authorities, took the man by ambulance to University Hospital in Newark, New Jersey.
Our client suffered severe injuries to his pelvis and both of his legs. He suffered an open book pelvis ring fracture, or a shattered pelvis, and fractures in both of his femurs. He also sustained a lateral meniscus tear in his right knee and a patellar rupture in his left knee. To treat his pelvis, the man underwent several open reduction and internal fixation (ORIF) procedures. His two femur fractures required fixation with instrumentation, and his patellar tendon required surgical repair. The man relied on a ventilator for twelve days after the accident, and he spent several weeks in an inpatient rehabilitation facility after his surgeries.

Lateral Meniscus Tear: The lateral meniscus is the crescent-shaped cartilage located on the outer side of the knee. It connects the knee to the tibia (shin bone), and is useful as a shock absorber between the femur and tibia. A torn meniscus is a really common injury that usually happens after a sudden twist or rotation of the knee.
Open Book Pelvis Ring Fracture: A break in one of the bones belonging to the ring that forms the pelvis.
Open Reduction and Internal Fixation (ORIF): A surgical procedure in which the pieces of a broken bone are repositioned, realigned, and held together with screws, plates, sutures, or rods.
Patellar Tendon: A complete tear of the patellar tendon, the tendon that runs from the kneecap to the tibial tubercle. The tibial tubercle is the bony bump on the upper part of the shin. The patellar tendon attaches the quadriceps muscles to the tibial tubercle.
Pelvis: The large boney structure that attaches your legs to the base of your spine.
A motor vehicle accident in New York injured a woman sitting in the passenger seat of a stopped car. After Davis, Saperstein & Salomon, P.C., partner Marc C. An 18-year-old from Hackensack, New Jersey sat in the backseat of a Pontiac Bonneville when the driver of the car lost control and swerved into a tree off the nearby road. After Davis, Saperstein & Salomon, P.C., partner Garry R. Salomon proved that, collectively, two different vehicles were negligent in causing the car accident, the teenager received a $1.5 million dollar settlement.
The teenager was in the backseat behind the passenger side enjoying a ride with his friends and listening to music. As the Pontiac traveled southbound on Central Avenue in West Caldwell, New Jersey, a 2-door Datsun pulled out into the intersection going westbound on Washington Avenue. The Datsun came from the left side and stopped toward the middle of the intersection—connecting Central Avenue, Washington Avenue, and Stonybrook Road—causing the Pontiac to swerve to the right and try to avoid the collision. The Pontiac then hit the curb on Stonybrook Road, causing the driver to lose control. The Pontiac collided with a tree on a nearby property.
The responding West Caldwell Police Department officers conducted four voluntary interviews with witnesses to the accident. In these interviews, the other passengers of the Pontiac stated that the driver never exceeded the speed limit, except to perhaps accelerate past the Datsun in the intersection. Both passengers of the Pontiac also claim that the Datsun did not stop at the stop sign. The negligent driver of the Datsun disputed this, testifying that she was stopped at the stop sign for as much time as it took for four different cars to pass through the intersection.
The West Caldwell Police Department found the teenager on the ground, ejected outside of the Pontiac. An ambulance took the teenager to the University of Medicine and Dentistry of New Jersey, now Rutgers School of Biomedical and Health Sciences. He was admitted in and out of the hospital for the following months, suffering from numerous permanent injuries to his internal organs: his liver, kidney, and colon. As a result, the teenager required surgery to remove a portion of his small intestines and his colon. He also underwent the installation of 5 different chest tubes, multiple abdominal drains, and intubations. Notably, the teenager was required to undergo a tracheotomy which left permanent damage and tracheal scarring. He was also left with a noticeable disfigurement in his back.
The injuries and procedures had long-term effects on the teenager. Following the accident, he had trouble with everyday tasks: sitting, walking, breathing. The young man, a New York college student, now majors in communications and is destined to become a sports announcer for professional hockey. Although the insurance coverage was limited, much of the settlement was crafted together with underinsurance coverage as well as the client’s family homeowner: insurance policies that provided certain umbrella UIM coverage as part of the masterpiece insurance policy purchased by the teenage client’s father well before the accident.
As a young man entering college, the injuries and accompanying scars also negatively affected his personal life.
